This agreement pertains to the rental of temporary fencing goods between Barwon Temporary Fencing and the Hirer, as described in the invoice provided by Barwon Temporary Fencing. It encompasses the establishment and use of the account, all transactions for goods and services, and excludes any other terms and conditions unless expressly agreed upon.
The Hirer agrees to hire the goods described in the invoice for the specified period, commencing from delivery and installation until the end of the hire period. Extensions of the hire period will be automatically invoiced unless instructed otherwise by the Hirer or terminated by Barwon Temporary Fencing.
Barwon Temporary Fencing will install the goods at the premises according to the Hirer's instructions. The Hirer must not affix banners, shade cloth, or any other items to the goods without obtaining prior written consent from Barwon Temporary Fencing.
Additional goods, if requested, will incur extra charges. The Hirer must pay the agreed hire fee during the hire period and is not entitled to a refund for early returns. The Hirer must also follow installation guidelines and ensure the goods' safety and preservation.
The Hirer has the option to move or change the position of the goods at their own risk. They agree to compensate Barwon Temporary Fencing for any loss or damage resulting from such actions. If the Hirer chooses to have Barwon Temporary Fencing move the goods, Barwon Temporary Fencing will disclose the cost upon engagement, which the Hirer must pay based on Barwon Temporary Fencing's standard terms for moving goods.
The Hirer indemnifies Barwon Temporary Fencing against any claims arising from the goods' use, including injury, loss, or damage. Payment of hiring charges must be in accordance with specified terms, and failure to pay may result in Barwon Temporary Fencing taking possession of the goods and charging additional fees.
The Hirer agrees to notify Barwon Temporary Fencing of any damage or loss, and use the goods appropriately. If the goods are returned in an unusable condition, the Hirer is responsible for repair or replacement costs.
Barwon Temporary Fencing may terminate the agreement if the Hirer breaches its terms. Termination allows Barwon Temporary Fencing to recover the goods from the premises.
Acceptance of the goods and installation confirms the Hirer's agreement to these terms. Barwon Temporary Fencing reserves the right to amend the agreement, with amendments becoming effective upon publication or notification to the Hirer.
